\u00e0 l\u2019ensemble des ventes et prestations de la soci\u00e9t\u00e9 EURL Vertical Fit 2, dont le si\u00e8ge social est situ\u00e9 au 171 rue de P\u00e9rigueux 16000 Angoul\u00eame inscrite au RCS d&rsquo;Angoul\u00eame sous le num\u00e9ro SIRET 931 781 637 00018 et exer\u00e7ant son activit\u00e9 sous l\u2019enseigne Vertical Fit, (ci-apr\u00e8s, \u00ab Vertical Fit \u00bb) aupr\u00e8s d\u2019acheteurs (ci-apr\u00e8s, le \u00ab Client \u00bb), d\u00e9sirant acqu\u00e9rir les produits (ci-apr\u00e8s, les \u00ab Produits \u00bb) ou b\u00e9n\u00e9ficier des prestations de services (ci-apr\u00e8s, les \u00ab Services \u00bb) propos\u00e9s par l\u2019\u00e9tablissement Vertical Fit au sein de son \u00e9cole situ\u00e9e 171 rue de P\u00e9rigueux \u00e0 Angoul\u00eame (ci-apr\u00e8s ; \u00ab Vertical Fit \u00bb).<br \/>They specify in particular the conditions of ordering, payment, delivery, and management of the Services ordered by the Customer as well as the cancellation conditions.<\/p>\r\n<p>The Customer declares to have read these General Conditions and to have accepted them.<\/p>\r\n<p>These Terms and Conditions may be subject to subsequent changes, the version applicable to the purchase of the Customer is the one in force on the date of placing the order.<\/p>\r\n<p>The General Conditions are available at Vertical Fit and on the website <a href=\"https:\/\/www.poledance-angouleme.fr\">https:\/\/www.poledance-angouleme.fr<\/a> https:\/\/www.vertical-fit.fr\/angouleme (hereinafter, the \"Website\") which allows the reservation of the Services.<\/p>\r\n<p>Unless proven otherwise, the data recorded in Vertical Fit's computer system constitutes proof of all transactions concluded with the Customer.<\/p>\r\n<p>The fact for the Customer, to order on the Website implies acceptance and full acceptance of these Terms and Conditions of Sale, which is expressly acknowledged by the Customer, who waives, in particular, to avail himself of any contradictory document, which would be inopposable to Vertical Fit.<\/p>\r\n<p>Conform\u00e9ment \u00e0 la loi Informatique et Libert\u00e9s du 6 janvier 1978, le Client dispose, \u00e0 tout moment, d\u2019un droit d\u2019acc\u00e8s, de rectification, et d\u2019opposition \u00e0 l\u2019ensemble de ses donn\u00e9es personnelles en \u00e9crivant, par courrier et en justifiant de son identit\u00e9, \u00e0 Vertical Fit &#8211; 171 rue de P\u00e9rigueux 16000 Angoul\u00eame ou \u00e0 l\u2019adresse \u00e9lectronique <a href=\"mailto:poledance16000@gmail.com\">poledance16000@gmail.com<\/a><\/p>\r\n<p>The validation of the order or the payment of the price by the Customer implies acceptance without restriction or reservation of the present General Conditions of Sale.<\/p>\r\n<p>The Customer acknowledges having the capacity required to contract and purchase the Products and \/ or Services offered by Vertical Fit.<\/p>\r\n<p>2 - Products and Services Orders<\/p>\r\n<p>2.1 - The Products<\/p>\r\n<p>The Customer must be of age at the time of placing the order for Products.<\/p>\r\n<p>Les Produits sont vendus exclusivement au sein de l&rsquo;\u00e9tablissement Vertical Fit au 171 rue de P\u00e9rigueux 16000 Angoul\u00eame.<\/p>\r\n<p>Product offers are subject to availability.<\/p>\r\n<p>2.2 - The Services<\/p>\r\n<p>2.2.1 - Description of the Services<\/p>\r\n<p>The Customer must be of age at the time of placing the order for Services.<\/p>\r\n<p>By ordering the Services, the Client certifies that he has made sure that he is not subject to any contraindications to the practice of sport and more specifically to the activities proposed by Vertical Fit, namely dance, flexibility and muscle building.<\/p>\r\n<p>Vertical Fit offers different types of Services, namely:<\/p>\r\n<p>- regular group lessons according to formulas in the past time or on a course card (pole dance, flexibility, muscular reinforcement etc ...);<\/p>\r\n<p>- private or semi-private lessons;<\/p>\r\n<p>- entertainment services for hen parties and stag nights;<\/p>\r\n<p>- performance-type performances;<\/p>\r\n<p>- Workshops type services;<\/p>\r\n<p>- room rental services;<\/p>\r\n<p>- Photo sessions<\/p>\r\n<p>2.2.2 - Terms of the Services<\/p>\r\n<ul>\r\n<li>Regular courses:<\/li>\r\n<\/ul>\r\n<p>Courses can be purchased either directly from Vertical Fit or from the website <a href=\"https:\/\/resafit.vertical-fit.fr\/\" rel=\"nofollow\">https:\/\/resafit.vertical-fit.fr\/<\/a><\/p>\r\n<p>Les cours r\u00e9guliers qui ont une dur\u00e9e de trente (30) minutes, d\u2019une (1) heure, d\u2019une heure et trente minutes (1h30) ou de deux heures (2h) sont d\u00e9finis selon un calendrier pr\u00e9\u00e9tabli par Vertical Fit, en fin de mois pour le mois suivant.<\/p>\r\n<p>Regular courses may be purchased under different forms and the rights conferred have a limited validity period:<\/p>\r\n<p>- They can be paid by the Customer to the unit and are in this case valid one (1) month from the date of purchase.<\/p>\r\n<p>- The Customer may also purchase 15, 30 or 60 credit cards with a validity period of three (3), six (6) and twelve (12) months, respectively, from the date of purchase.<\/p>\r\n<p>\u2013 Le Client peut \u00e9galement acheter des pass illimit\u00e9s ayant une dur\u00e9e de validit\u00e9 respective de un (1), trois (3) et douze (12) mois, \u00e0 compter de la non-prolongeables<\/strong>.<\/p>\r\n\r\n\r\n\r\n<p>Seul l&rsquo;achat d&rsquo;une nouvelle carte prolonge la dur\u00e9e de validit\u00e9 de l&rsquo;ancienne carte de l&rsquo;\u00e9quivalent de la dur\u00e9e de validit\u00e9 de la nouvelle carte. <br \/><strong>Attention : l&rsquo;achat de cr\u00e9dit(s) \u00e0 l&rsquo;unit\u00e9 (1, 2 ou 3 cr\u00e9dits) ne prolonge pas la dur\u00e9e des cartes de cours.<\/strong><\/p>\r\n\r\n\r\n\r\n<p><strong>Les cr\u00e9dits de votre carte peuvent \u00eatre gel\u00e9s en cas d&rsquo;inaptitude m\u00e9dicale \u00e0 la pratique de la pole dance ou de grossesse SUR PRESENTATION D&rsquo;UN CERTIFICAT MEDICAL OU D&rsquo;UNE DISPENSE DE SPORT UNIQUEMENT.<\/strong><\/p>\r\n\r\n\r\n\r\n<p>Dans le cas particulier d&rsquo;une grossesse, les cartes seront gel\u00e9es au maximum pendant une dur\u00e9e de 2 ans apr\u00e8s l&rsquo;arr\u00eat des cours + le restant de la dur\u00e9e de validit\u00e9 de la carte. Par exemple, si le Client poss\u00e8de une carte valable un an et qu&rsquo;il a d\u00e9j\u00e0 effectu\u00e9 6 mois de cours, sa dur\u00e9e de validit\u00e9 apr\u00e8s sa date d&rsquo;arr\u00eat sera de 2ans et 6 mois. Le nombre de place \u00e0 chacun des cours \u00e9tant limit\u00e9, il est obligatoire pour le Client de r\u00e9server ses cours sur le site <a href=\"https:\/\/resafit.vertical-fit.fr\/\" rel=\"nofollow\">https:\/\/resafit.vertical-fit.fr\/<\/a> Les r\u00e9servations peuvent \u00eatre annul\u00e9es sans frais jusqu\u2019\u00e0 vingt-quatre heures (24h) avant le d\u00e9but de celui-ci. Par exemple, si le Client poss\u00e8de un pass illimit\u00e9 1 an et qu&rsquo;il a d\u00e9j\u00e0 effectu\u00e9 6 mois de cours, sa dur\u00e9e de validit\u00e9 apr\u00e8s sa date d&rsquo;arr\u00eat sera de 2 ans et 6 mois. Si pass\u00e9 ce d\u00e9lai, le Client n&rsquo;a pas repris les cours, le pass sera perdu.<\/strong><\/p>\r\n\r\n\r\n\r\n<p>The number of places for each course is limited, it is mandatory for the Customer to book his courses on the site <a href=\"https:\/\/resafit.vertical-fit.fr\/\">https:\/\/resafit.vertical-fit.fr\/<\/a> m\u00eame s&rsquo;il poss\u00e8de un pass illimit\u00e9. En cas d&rsquo;impossibilit\u00e9 \u00e0 venir \u00e0 un cours r\u00e9serv\u00e9, le Client devra se d\u00e9sinscrire du cours au moins 24h avant le d\u00e9but du cours. <br \/>En cas de non-pr\u00e9sentation \u00e0 un cours r\u00e9serv\u00e9 ou d&rsquo;annulation tardive (- de 24h avant le d\u00e9but du cours), Vertical Fit se r\u00e9serve le droit de bloquer le compte R\u00e9safit de l&rsquo;\u00e9l\u00e8ve dans les dispositions \u00e9nonc\u00e9es ci apr\u00e8s (blocage du compte de r\u00e9servation R\u00e9safit en cas d&rsquo;abus).<\/p>\r\n<p><strong>Blocage du compte de r\u00e9servation R\u00e9safit en cas d&rsquo;abus :<\/strong> <br \/><strong>Pour les Clients ayant des cartes de cours ou des pass illimit\u00e9s<\/strong>, Vertical Fit bloquera le compte de r\u00e9servation de cours s&rsquo;il est constat\u00e9 : <br \/>&#8211; Plus de 3 absences au cours sans d\u00e9sinscription pr\u00e9alable par le site de r\u00e9servation sans justificatif m\u00e9dical <br \/>&#8211; et\/ou Plus de 3 d\u00e9sinscriptions tr\u00e8s tardives au cours (- de 3h avant le d\u00e9but du cours) sans justificatif m\u00e9dical <br \/>&#8211; et\/ou Plus de 3 retards de plus de 10 minutes<br \/>&#8211; et\/ou un comportement d\u00e9plac\u00e9 en cours envers le professeur ou les autres \u00e9l\u00e8ves.<br \/>Dans ces cas, Vertical Fit se r\u00e9serve le droit de ne plus accepter le Client en cours pendant une p\u00e9riode d&rsquo;un mois, <strong>et ceci sans d\u00e9dommagement ni prolongation de sa carte ou de son pass illimit\u00e9<\/strong>. <br \/><strong>Pour les Clients n&rsquo;ayant pas de carte de cours ni de pass illimit\u00e9 en cours de validit\u00e9<\/strong>, en cas d&rsquo;abus, leur compte R\u00e9safit pourra \u00eatre d\u00e9sactiv\u00e9 imm\u00e9diatement, et ce d\u00e8s le 1er abus.<\/p>\r\n\r\n\r\n\r\n<p>Si le Client s&rsquo;inscrit \u00e0 des cours en dehors de la p\u00e9riode de validit\u00e9 de son pass, ces cours devront \u00eatre r\u00e9gl\u00e9s.<\/p>\r\n\r\n<ul>\r\n<li>Cours collectifs<\/li>\r\n<\/ul>\r\n\r\n<p>Les cours collectifs sont planifi\u00e9s mois par mois sur le <a href=\"https:\/\/resafit.vertical-fit.fr\/4\/cours\/index\" target=\"_blank\" rel=\"noreferrer noopener\">planning en ligne<\/a>. Ils sont assur\u00e9s \u00e0 partir de quatre (4) inscrits (le nombre d&rsquo;inscrits doit \u00eatre au moins de 4 personnes \u00e0 14h le jour du cours (ou la veille au soir pour les cours du samedi), sinon le cours est annul\u00e9). Si un cours est annul\u00e9, les Clients sont pr\u00e9venus par SMS. Le nombre maximal d&rsquo;inscrits est de quatorze (14) pour la pole ou les activit\u00e9s sans agr\u00e8s a\u00e9riens.
